In the Bronx, the dividing line is $50,000: probate and administration handle larger estates, and a dedicated department handles small estates.

What Happens After a
Loved One Passes
Obtain the Death Certificate
Request certified copies from the funeral home or NYC vital records.
Locate the Will (If One Exists)
Check the decedent's records, attorney files, and safe deposit box — the Probate Department handles requests to open a safe deposit box.
Determine the Type of Proceeding
In the Bronx, the line is $50,000: probate or administration above it, small estate below it.
Gather Required Documents
Death certificate, will, asset information, heir details, and required court forms.
File the Petition
Submit your petition to Bronx County Surrogate's Court on the 3rd floor at 851 Grand Concourse.
Serve Citation to Interested Parties
The court requires personal service on domiciliaries (SCPA Article 3), and the Virtual Appearance Notice must be served with every citation.
Appear — Virtually
Calendar appearances are conducted virtually; to appear in person, notify the court at least 3 business days ahead.
Administer the Estate
Collect assets, pay debts and taxes, and distribute — the inventory of assets is due 9 months after letters issue.
