Suffolk plays by its own local rules.
Suffolk has had mandatory Surrogate's Court e-filing since January 24, 2018, and the court's NYSCEF e-filing protocol sets out Suffolk-specific rules many filers don't expect: the original will must be filed on paper within 2 business days of e-filing (scanned without removing the staples), the certified death certificate is also due within 2 business days, and before filing you must contact the court to ask whether a will is on file with the court for safekeeping.

What Happens After a

Obtain the Death Certificate
Request certified copies early — in Suffolk a certified death certificate must be filed within 2 business days of e-filing.
Locate the Will (If One Exists)
Check the decedent's records and attorney files — and remember the Suffolk court accepts wills for safekeeping.
Determine the Type of Proceeding
Probate (with a will), Administration (no will), or Small Estate.
Gather Required Documents
Death certificate, will, asset information, heir details, and required court forms.
File the Petition
Most new cases are filed electronically through NYSCEF — mandatory in Suffolk since 2018 for represented filers.
Serve Citation to Interested Parties
All heirs and beneficiaries must be notified via citation or waiver.
Appear Before the Court
Suffolk runs a weekly process calendar; conferences and hearings may be held by Microsoft Teams.
